We will dispatch the images by the method required.
Then it's legal.
In this agreement, the party granting the right to use the licensed property, Banapro, will be referred to as ("Licensor"), the party who is receiving the right to use the licensed property will be referred to as ("Licensee") The following title names shall be referred to as ("Product") in this agreement, and are all the products covered with this agreement. The Licensor agrees to license the following titles to the Licensee:
Licensee agrees to pay to Licensor one-time lifetime fee for this Product(s). Of $0. The Licensor may (or will) revoke the license if any of the terms or conditions of this license are violated, if Licensee declares bankruptcy, sells or closes the business, obtains a refund of the product or fails to pay. Involuntary revocation of the license does not grant Licensee any refund of the payment made. This license is not transferable. All sales are final and no refunds could be given unless Licensor decides to give a refund.
The Licensor who owns and distributes the Product, named above. Grants in accordance with this agreement a Non Exclusive license to only show the images on the Internet. This license for the above product, can and will be issued to other companies at Licensor's discretion.
The Licensee does not have the right to resell, rent, lease. Banapro retains title and ownership of the Product, and gives up no legal rights as part of this agreement. Licensee agrees not to sell or distribute this Product for viewing/publishing via any physical method (such as diskette, CD Rom, paper printing or any other technology not specifically named in this document) without additional written permission and payment of fees. The images shall not be used on any "Lease Gallery sites" for instance where other sites pay a fee to send their members or Free Hosted Galleries or as free content given to affiliates.
The Licensee or their agents or affiliates do not have the right to post, publish or in any way distribute the content to Czech websites, websites worded in Czech or Czech affiliates.
Licensee acknowledges that unauthorized reproduction of copies of the licensed material may constitute a serious crime, and that such actions may also result in a suit for damages, injunctive relief, and attorney fees, pursuant to this agreement and to other rights that the licensor may have. Licensee may not alter the images to make them appear to be the copyrighted property of anyone other Banapro. The Licensee must not publish or reveal the models real name, Identification Documents, address or any factual details regarding their true identity, except to officials of the Justice Department or other law officials as may be legally required under 18U.S.C. 2257 or and other current or future legal/government requirements applicable to the publishing of this/these products. Changing the content of the material (such as morphing or editing another person or object into the photo, or changing the appearance of one that is there) is NOT allowed.
Websites; The Licensee has the right to publish them on up to ten domains/URLs. If you require more contact us.
Thumbnail Gallery Posts; In addition to the 10 named sites you may post up to 20 images at one time on TGPs or AVSs, so long as the promotion site is directly linked to the Licensees site displaying the product. Licensees are allowed to use the product on the clients mobile phone system for delivering the product to their clients. Licensees are allowed to purchase product to promote other companies or persons sites on their 10 named sites.
You have the right to give content to affiliates for them to promote your website.
In addition to displaying the images on up to 10 domains you can post up to 20 images on as many TGPs or AVS sites as you wish. This site has to be directly linked to YOUR site displaying these images. Unless you are buying to drive traffic to another persons website.
Banner/Webpage design is allowed.
Image resizing and editing is allowed.
Retouching the image to cover sexually sensitive material in "public" areas is allowed.
Adding your URL to the images is allowed. In fact we advise it to deter content theft.
This license will automatically terminate without notice if you fail to comply with any of it?s terms or if a petition of bankruptcy or receivership is filed by or against you, or if you are judged insolvent or if you liquidate/cease the business in any way. No notice will be required from Banapro to effect such termination. Upon termination all rights & licenses granted to you under this license shall terminate effective immediately and you will immediately destroy the copies of images. Banapro has the right to redistribute as they sees fit.
The laws of the State of Residence of the Licensor shall govern this agreement. Licensee holds Banapro harmless for any legal issues related to the distribution of the material as it relates to community standards and adult entertainment laws as set forth in any city/country, state or country of Licensee and their websites. Licensor does not warrant this material to be acceptable in your community, and Licensee assumes full responsibility for determining what images are suitable for distribution. Licensor warrants the images are fully copyrighted, and this license warrants these images free of intellectual property violations only. These images are in compliance with the 18 USC Section 2257 US Federal law, and any inquiries made under this law must be directed to Licensor.
The Licensee will receive a copy of the models, IDs and model release. We will reserve the right to remove any contact, ?Next of Kin? address, etc. details from the documents. Paul Markham is the custodian of records and keeps the Records Required by 18 U.S.C. 2257 and associated Regulations with respect to the photographs included herein. Publishers certify to all commercial purchasers that the aforesaid materials are in full compliance with the requirements of 18 U.S.C. 2257 and associated regulations. All persons depicted herein were at least 18 years of age at the time of the photography.
